Terms and conditions of sale BBLACK CRUISE

Thank you for purchasing a BBLACK CRUISE PASS. Please be advised that these terms and conditions apply to the sale of BBLACK CRUISE PASSes for the April 2024 edition.

These General Terms and Conditions specify the conditions for immediate purchase, order placement, payment and delivery of tickets ordered.

These GTC apply to the exclusion of all other conditions.

These terms and conditions are systematically communicated to each participant prior to the immediate purchase or the placing of an order, and will prevail, where applicable, over any other version or any other contradictory document.

The participant declares that he/she has read and accepted these terms and conditions before making an immediate purchase or placing an order, it being understood that payment implies acceptance of these terms and conditions.

By placing an order, participants declare that they have read and accepted these terms and conditions of sale.

 

BBLACK may amend the GTC at any time. All changes will become effective immediately upon posting on our website. The "Effective Date" date above will tell you when the T&Cs were last revised. To the extent that these GTC differ from any prior version of the GTC to which you have previously consented, that version of the GTC shall prevail and govern.

IMPORTANT: By purchasing a BBLACK CRUISE PASS, you automatically accept the general terms and conditions of sale of the cruise line and, where applicable, of our partners involved in the provision of services associated with this pass (travel agency in particular). You can consult the MSC Croisières terms and conditions by following the link below.

It is your responsibility to familiarize yourself with these terms and conditions, as they govern all transactions, reservations or services specific to their field of activity. Your automatic acceptance of these conditions is a prerequisite to fully benefit from your pass and its associated advantages.

Art.1 – PRESENTATION

 

BBLACK EXPERIENCE (SARL with capital of €5,000 registered with the CRETEIL Trade and Companies Register under SIREN number 978 957 504) hereinafter referred to as BBLACK, refers to the company whose head office is located at 1, voie Felix Eboue 94000 Créteil, France, which organizes and provides themed cruise services in partnership with cruise lines and travel agencies under the name "BBLACK CRUISE".

BBLACK CRUISE 2024 is a 4-day / 3-night festival departing from Miami and taking place aboard the MSC Magnifica (a ship of the cruise line MSC Cruises, hereinafter referred to as the cruise line) organized by BBLACK.

Art. 2 - PASS DESCRIPTION

 

2.1 The BBLACK CRUISE PASS is a pass allowing access to all BBLACK CRUISE events (excluding V.I.P. options) taking place throughout the BBLACK CRUISE 2024. Its sale is inseparable from the purchase of a cabin aboard the ship.

 

2.2- CONDITIONS OF PARTICIPATION : BBLACK CRUISE is open to all visitors with a BBLACK CRUISE pass. Each PASS is personal and non-transferable.

 

2.3 The purchase of a standard cruise directly from the cruise line or another third party (refer to article 3.4) does not allow access to BBLACK CRUISE events.

Art. 3 – BOOKING

 

3.1 Prices and booking conditions

Prices are shown in euro.

Prices are based on the rates in force at the time of booking.

A deposit is required to reserve a BBLACK CRUISE PASS.

Reservations are only definitively confirmed once the full amount has been paid, at the latest one month before the start of the BBLACK CRUISE.

 

3.2 Online registration

 

You can fill in the registration form on the official BBLACK CRUISE website. www.bblackcruise.com.

 

3.3 Online payment

Online payments can only be made by credit card. Cards accepted for payment are Carte Bleue / Visa / Eurocard and Mastercard.

The credit card payment system is equipped with a security protocol that allows you to make your payments with complete peace of mind.

 

BBLACK can not be held responsible for errors made by the buyer when ordering. (Incorrect recipient details, credit card number error, validity date error, incorrect email, incorrect ID number, etc.).

 

3.4 Purchases from third-party providers

 

3.4.1 BBLACK CRUISE participants must make their reservations directly on www.bblackcruise.com or through our partner travel agencies, such as :

Purchases from unauthorized third-party providers do not guarantee participation in the event.

Partner travel agencies may offer additional options (flight/hotel) and charge additional services (agency fees, management fees, etc.). BBLACK cannot be held responsible for these special conditions. These other services are not linked in any way to BBLACK CRUISE and do not fall within the scope of these general terms and conditions of sale. Participants are invited to consult the terms and conditions of sale of each service/provider.

 

3.4.2 Our company cannot be held responsible for purchases made from unauthorized third-party providers, and such purchases will not be recognized as valid for participation in BBLACK CRUISE.

 

3.4.3 Participants are encouraged to check the authenticity of third-party providers and confirm their status as approved partners before making purchases.

 

3.5 Monthly payment plans :

3.5.1 For passengers who are unable to pay for their cruise in full at the time of purchase, we offer, as a courtesy, a payment plan that will divide your payment into monthly installments based on the date of your reservation. You will receive a payment schedule detailing the payment plan, including automatic monthly installments and the dates on which payments are due.

3.5.2 A non-refundable deposit (based on the number of passengers in your cabin) is due at the time of booking for each guest as follows:

Interior : 200€ /person

Sea view : €250 /person

Balcony : €280/person

Suite : On request

3.5.3 The balance of your cabin will be divided into equal monthly payments to be debited on the 5th of each month after payment of your initial deposit, with the final balance due no later than March 5, 2024.

3.5.4 Once the first passenger has made the initial payment for a multiple-passenger booking, an e-mail will be sent to the other passengers mentioned at the time of booking so that they can pay their deposit. Additional passengers included in the booking will have 48 hours from receipt of this e-mail to make their own payment. If a passenger does not make his or her deposit payment within this 48-hour period, the amount of that passenger's deposit will automatically be billed to the first passenger who made the initial payment. This measure guarantees the reservation for the whole group and avoids any inconvenience linked to the non-payment of additional passengers.

3.6 Promotional codes : Promotional codes offered by BBLACK are not cumulative, unless expressly indicated otherwise. This means that only one promotional code may be applied per transaction. Specific terms of use for each promo code, including expiration dates and restrictions, will be indicated in promotional communications or on the BBLACK CRUISE website.

3.7 Group reservations : It is imperative that you indicate that you belong to a group at the time of reservation by using the field provided for this purpose. This information is essential to enable us to accommodate you in cabins located close to each other. We do our best to accommodate all group requests, but this is subject to availability and capacity. However, if a customer or group member fails to indicate their group membership at the time of booking or fails to provide the necessary information, BBLACK cannot guarantee that group members will be accommodated in adjacent cabins. In such cases, if the customer wishes to change cabins to bring group members closer together after booking, additional costs may be charged depending on cabin availability.

 

3.5 Booking confirmation : Once full payment has been received, you will receive an email confirming your purchase of the BBLACK CRUISE. This email serves as proof of purchase and includes your PASS number (or bar code or QR code/MSC Croisières reservation number). It will not be possible to collect your PASS without this confirmation. Please check your e-mail, save and print the confirmation e-mail.

 

3.8 PASS withdrawal : You can collect your PASS directly from the BBLACK CRUISE welcome desk at the time of boarding. You'll need to present a printout of the confirmation e-mail we've sent you, together with proof of identity. Without these two items, your PASS will not be issued.

Important : the credit card is debited independently of the actual ticket collection. In any case, passes are paid for even if you do not collect them. Passes that have not been collected cannot be claimed and therefore cannot be refunded.

 

Art. 4 - RULES APPLIED TO PASSES

 

BBLACK CRUISE passes must be kept for the duration of the BBLACK CRUISE.

The resale of BBLACK CRUISE PASSES is STRICTLY forbidden. This will result in the cancellation of the PASS with no possibility of refund.

PASSes are essential for access to every BBLACK CRUISE event and must be presented at the entrance. The PASS may be checked at any time during the BBLACK CRUISE by our organization teams (during the party, for example).

Art. 5 - CABIN RATES AND ADMINISTRATIVE FEES

5.1 Cabin rates include cabin accommodation, most meals (except specialty restaurants), unlimited beverage experience, welcome party and all BBLACK CRUISE events on board and ashore.

5.2 Cabin rates are calculated per person based on cabin occupancy (cabins can accommodate 1, 2, 3 or 4 peope).

5.3 Cabin rates are based on double occupancy. Any guest traveling alone in a cabin is required to pay the rate for double occupancy.

5.4 Rates and cabin availability are subject to change at any time without notice.

5.5 Please note that the inventory in the online cabin price list may not reflect real-time availability.

5.6 SCHEDULE OF TAXES AND FEES

  • Unlimited alcoholic and non-alcoholic beverages : Included in cabin price (EASY package of MSC)

  • Administration fee : 150€ /person: Included in cabin price

  • Stay fee : 45€ per person

  • Name change fee : 80€ per change

  • Cabin change fee : 80€ per change

  • Direct debit rejection fee : 29€ per transaction

Art.6 – CANCELLATION

In accordance with article L.121-25 of the French Consumer Code, the customer has 7 days to withdraw from the contract, including weekends and public holidays. To do so, the customer must send a registered letter with acknowledgement of receipt to cancel the contract. When purchasing a PASS for the BBLACK CRUISE, payment is considered a contract that cannot be freely cancelled.

The purchase of a PASS cannot be cancelled and cannot give rise to a refund.

No-shows at BBLACK CRUISE do not entitle customers to a refund. The organization retains the total amount of the order.

 

Art. 7 - BOOKING CHANGES

7.1 BOOKING CHANGES BY PRINCIPAL GUEST ONLY : The passenger who books a cabin aboard the BBLACK CRUISE is considered the "principal guest" of that cabin and is the "owner" of the booking. The main guest is therefore solely responsible for initiating or authorizing changes to the booking, and must accept all changes to the booking, by sending an e-mail to cruise@bblack.tv.

7.2 NAME CHANGE : All NAME changes can be made up to 30 days prior to departure (if authorized by the cruise line) and an administrative fee of €80 will be charged for each NAME change.

7.3 The main guest is not allowed to change his/her name in the booking. The name of at least one "original" and/or main guest must remain on the booking. If all original passengers cancel, this is considered a complete cancellation without refund, and name changes will not be allowed. An original name is a name that was added to your reservation at the time of your initial deposit or payment.

7.4 In all cases of name change, the NEW passenger must agree to resume payments where the previous passenger left off. Both the original passenger and the replacing passenger are responsible for reimbursing any amounts owed to each other. The cost of the name change fee, however, must be paid directly to BBLACK. Changing the names of all passengers from one room to another in the form of downgrading is not permitted. A downgrade is considered a cancellation of the original reservation.

7.5 CHANGING CABIN OCCUPANCY : Rates are based on the number of people in your cabin. Any change in occupancy will result in a rate increase or decrease, depending on the type of change.

7.6 CABIN UPGRADING / DOWNGRADING : Passengers may upgrade to a higher cabin category at any time, subject to availability. Downgrades are not permitted. Requests for upgrades should be sent by e-mail to the following address: cruise@bblack.tv.

7.7 All changes are subject to approval by the organizer and/or the company, and subject to availability. Adjustments will be charged at the price in effect at the time of booking, plus any change fees, all subject to the organizer's discretion.

 

Art. 8 - SCHEDULING

 

The organizer reserves the right to modify schedules and programs. No refunds will be given for changes to the program or timetable, or for the interruption of an event.

 

The BBLACK CRUISE team also declines all responsibility for any cancellations or withdrawals on the part of artists. We cannot guarantee the presence of any particular guest in the event of an impediment due to circumstances beyond our control.

 

Art. 9 – FORCE MAJEURE

 

For the purposes of these general terms and conditions of sale, Force Majeure is any event, reasonably unforeseeable and insurmountable for the Service Provider, which makes the performance of all or part of its contractual obligations under the Service impossible or significantly more onerous.

Force Majeure includes, but is not limited to, the following events: natural disasters, bad weather, fire, flood, earthquake, strike or other industrial action, power failure, administrative decision, embargo, sabotage, intervention by civil or military authorities, acts of war, declared or undeclared hostilities, terrorist acts or riots.

Cancellations due to force majeure will not be eligible for a refund.

 

BBLACK will not be considered as not respecting its obligations in the case where the execution of its obligations under the service is obstructed, prevented or delayed by a case of Force Majeure and its responsibility would not know, in this case, to be committed for whatever cause that it is.

Art. 10 – CODE OF CONDUCT

 

All BBLACK CRUISE participants must read our code of conduct and agree to abide by it. 

 

Art. 11 - RIGHT TO ONE'S IMAGE

 

By acquiring a PASS for BBLACK CRUISE, each participant expressly authorizes the organization (and its partners), free of charge, to use, have used, reproduce or have reproduced his or her name, image and voice captured during the cruise, with a view to promoting the cruise and the event and publishing activities of the BBLACK group and its partners, on all media and by all means, current technical methods known or unknown to date. Any participant in the BBLACK CRUISE authorizes BBLACK or any other person that the latter would substitute, to capture, fix, duplicate, record, reproduce, film and / or photograph, adapt, modify, transform, distort, truncate, by all means, all processes and by all communication networks known or unknown to date.

 

Art.12 – CNIL (FRENCH DATA PROTECTION AUTHORITY)

 

In accordance with the French Data Protection Act of January 6, 1978, all participants have the right to access and rectify their personal data. The information collected at the time of booking is processed for BBLACK CRUISE's customer database. The information and data concerning you are essential for the management of your order as well as for our commercial relations. They also enable BBLACK to contact you, where possible, to notify you of a change in schedule, for example.

 

Art.13 - CRUISE ITINERARIES

 

13.1 The BBLACK CRUISE "Miami Trip" itinerary is posted on the website.

To avoid disappointment, we recommend that incoming flights arrive no later than Thursday, April 04, 2024. This will give you ample time to check in and board before 11:00 A.M the following day, Friday April 5, 2024.

13.2 RIGHT TO CHANGE ITINERARY : BBLACK and/or the cruise line reserve the right, at any time, to change the cruise itinerary without notice and at their sole discretion.

SUCH A CHANGE DOES NOT CONSTITUTE A CANCELLATION. In such event, BBLACK and/or the cruise line will NOT be liable for any loss or expense caused by such changes or abandonment.

Passengers who choose not to complete the cruise for any reason will NOT be refunded.

 

Art.14 - VACCINATION AND HEALTH

 

14.1 All passengers must ensure that they are medically and physically fit to travel. BBLACK accepts no responsibility if you do not meet the medical requirements for travel. The Ministry of Health and Prevention, the World Health Organization (WHO) and the cruise lines provide guidelines on the vaccinations required in each country. In many cases, vaccinations are recommended, but in some circumstances they are mandatory. We recommend that you consult your health care professional or a WHO-certified travel medicine specialist for advice.

14.2 MEDICAL CARE

 

You assume all risks associated with travel and transportation aboard the cruise. At sea or in port, the availability of medical care may be limited and/or delayed. You acknowledge that all or part of the cruise may take place in areas where medical care and/or evacuation is not available.

You agree to fully indemnify and reimburse BBLACK and/or the cruise line if BBLACK, in its sole discretion, advances you the cost of emergency medical care, including medical evacuation and/or emergency medical care provided on the ground, as well as transportation and/or lodging in connection with such care. BBLACK is not required to advance these costs.

We strongly recommend that you take out travel insurance to cover any unforeseen medical expenses and repatriation if necessary.

 

14.3 VACCINATION REQUIREMENTS AND OTHER RULES

The cruise line has established protocols and procedures related to public health and safety, which may be updated, revised, amended or modified from time to time by the cruise line and which may include mandatory testing and/or vaccinations for SARS-CoV-2/COVID-19. Passenger requirements will be consistent with those generally imposed on cruise line passengers.

BBLACK is not responsible for Covid-19 requirements that cruise lines, travel suppliers, governments and regulatory bodies may impose from time to time, such as required vaccinations, sworn health declarations, Covid-19 screenings prior to departure, during travel and upon arrival, wearing of masks or quarantine, etc. You assume full responsibility for all such requirements.

You assume full responsibility for verifying that you comply with Covid-19 and other travel requirements of your destination and connecting points, as well as any conditions relating to health, safety, political stability, labor disputes or civil unrest in that destination. For the latest rules of cruise lines, travel suppliers or governments, consult the websites of the cruise lines, travel suppliers and government agencies concerned, and BBLACK Experience cannot be held responsible for these changes.

 

Art.15 TRAVEL DOCUMENTS, PASSPORTS AND PROOF OF CITIZENSHIP

 

15.1 All passports, visas and other travel documents required for embarkation and disembarkation and at all ports of call or otherwise required for entry into all countries are your sole responsibility. It is your sole responsibility to identify and obtain all required travel documents and to have them available when needed. In particular, valid travel documents such as passport, visa, vaccination certificate and legal family documents are required for boarding the ships and entering and/or re-entering the countries. Passengers who do not possess the appropriate documents may be prevented from boarding their flight or ship or entering a country, and may be subject to fines. No refunds will be given to people who have not brought the appropriate travel documents. International travel generally requires a valid passport. Visas may be required depending on the destination. Citizens of countries other than the United States should contact the embassy or consulate of the destination country for entry requirements.

15.2 We strongly recommend that all passengers travel with a passport (valid for at least six months after the end of the trip). Having a valid passport will allow you to fly from the U.S. to a foreign port in case you miss your scheduled boarding, or to return to the U.S. if necessary.

15.3 BBLACK is not responsible for any delays you may experience due to incomplete or incorrect travel documents. If you are not in possession of valid documents, you will be denied boarding or entry and will not be entitled to any refund or compensation. Full compliance with all customs regulations and all local and national laws is your own responsibility and neither BBLACK nor the travel suppliers can be held responsible for non-compliance.

15.4 We strongly recommend that all participants start with the administrative formalities (including passport or ESTA applications) before booking BBLACK CRUISE.

Art.16 - SAFETY IN PORTS OF CALL AND ON BOARD

 

You assume full responsibility for your safety on board and at any port of call.

BBLACK does not guarantee your safety at all times.

You acknowledge that all shore excursions and tours of any kind are operated by independent contractors.

BBLACK does not supervise or control their actions, and makes no representations, express or implied, as to their activities. These services are provided solely as a convenience to you and you are free to use or not use them. You agree that BBLACK assumes no responsibility, does not guarantee performance and shall in no event be liable for any negligent or intentional acts or omissions, losses, damages, injuries or delays suffered by you and/or your property in connection with these services. Use at your own risk.

 

Art 17 - LUGGAGE

 

Each passenger may take on board a reasonable amount of baggage. All luggage must be stowed in the passenger's cabin. Pets, dangerous or illegal items such as weapons, explosives, combustible substances, over-the-counter controlled substances or illegal drugs may not be brought on board the ship. Such items must be handed over to security upon boarding, and may be disposed of.

All baggage, whether hand-carried or checked, and your person are subject to security inspections which may involve a body search. Porters are available at the pier during embarkation to carry luggage to the ship. Please ensure that each piece of luggage is locked and labelled with

your name, the ship's name and the cabin number. The cruise line and BBLACK assume no responsibility for hand luggage. Any luggage left at the pier will be returned at the passenger's expense.

Claims for lost or damaged baggage must be made in writing to the disembarkation staff before leaving the pier area.

Art. 17 ZERO TOLERANCE POLICIES

 

17.1 DRUGS POLICY :

 

BBLACK and the cruise line have a zero tolerance policy regarding the use, possession, purchase or distribution of illegal controlled substances. Any violation of this policy will result in disembarkation from the ship and surrender of the individual to local law enforcement authorities.

In this case, BBLACK and the cruise line cannot be held responsible for any refund or other compensation or damages.

 

17.2 THREATS AND VIOLENCE :

BBLACK and the cruise line have a zero tolerance policy regarding threats and violence.

No act of violence whether verbal, physical, (including verbal or physical threats such as death threats, oral or written threats against persons or property and implied threats) will be tolerated, whether against passengers, ship personnel or property.

Any violation of this policy will result in cancellation of your reservation, immediate disembarkation, arrest and/or criminal prosecution, as appropriate. In such cases, BBLACK and the cruise line will not be liable for any refund or other compensation or damages.

 

17.3 DISCRIMINATION AND SEXUAL HARASSMENT

BBLACK and the cruise line have a zero tolerance policy regarding discrimination and sexual harassment.

Any form of discrimination, whether based on gender, sexual orientation, age, race, religion, or any other personal characteristic, is strictly prohibited. Similarly, sexual harassment in any form, whether inappropriate comments, non-consensual touching or any other inappropriate conduct, is unacceptable.

Any violation of this policy will result in cancellation of your reservation, immediate disembarkation, arrest and/or criminal prosecution, as appropriate. In such cases, BBLACK and the cruise line will not be liable for any refund or other compensation or damages.

 

17.3 SMOKING POLICY

Smoking (including electronic cigarettes) is prohibited in cabins, on cabin balconies and in any area not indicated as a smoking area by signs or the presence of ashtrays.

Smoking in non-smoking areas is subject to cleaning charges, and continuing to smoke where it is not permitted may lead to disembarkation.

It is forbidden by international maritime law to throw a cigarette or anything else overboard.

Any violation of this policy will result in cancellation of your reservation, immediate disembarkation, arrest and/or criminal prosecution, as appropriate. In such cases, BBLACK Experience and the cruise line will not be liable for any refund or other compensation or damages.

 

Art. 18 VENDING

 

NO VENDING OF ANY KIND IS ALLOWED during the cruise unless you are a BBLACK approved sponsor or vendor. This includes, but is not limited to, the sale of goods, products or services of spa, salon and haircut, makeup, manicure, pedicure, massage, facial, etc,

Please do not make t-shirts, hats, posters, jewelry or other items for sale. Anyone violating this policy will have their unauthorized merchandise confiscated.

 

Art 19 ROOMMATES / ROOM-SHARING PROGRAM

 

Your decision to accept a roommate for the cruise is at your sole risk. BBLACK is not responsible for any claims arising out of or in connection with the assignment of a roommate to the cruise, including, but not limited to, any injury or damage to persons or property that may be caused, directly or indirectly, in whole or in part, by third parties.

 

Art 20 LIABILITY FOR DAMAGE CAUSED BY PASSENGERS

 

You are responsible for and must reimburse BBLACK and the suppliers for any damage to the vessel, transportation vehicles, hotel, resort or other property of BBLACK or the suppliers, caused directly or indirectly, in whole or in part, by any willful or negligent act or omission of BBLACK or the suppliers, or negligence on your part.

You will be liable to BBLACK and Suppliers for any fines or penalties imposed on BBLACK or Suppliers by any governmental authority for your failure to comply with local governmental laws or regulations, including requirements relating to immigration, customs, crime or illegal immigration.

Art. 21 - APPLICABLE LAW / DISPUTES

 

This PASS sales contract is governed by French law. The language of this contract is French. In the event of a dispute, the Paris court shall have sole jurisdiction.

Art.22 - ACCEPTANCE OF THE RULES

 

By registering for BBLACK CRUISE, each participant acknowledges that he/she has read these rules and expressly accepts them without reservation.
